India’s tax landscape is undergoing its most sweeping transformation in six decades. The Income Tax (No. 2) Bill, 2025 has received parliamentary approval and will come into force on April 1, 2026. As part of this overhaul, the CBDT released draft Income-tax Rules, 2026 — and tucked within those rules are specific, important changes that directly affect children and their PAN (Permanent Account Number) cards.

1. The Big Headline: Birth Certificates Are Now Mandatory

The New Rule in Plain English

Children born on or after October 1, 2023 must now present an official birth certificate as proof of date of birth when applying for a PAN. Previously, a variety of documents were acceptable. That flexibility is now removed for children born after this date.

The birth certificate must be issued by the municipal authority, any office authorised by the Registrar of Births and Deaths, or the Indian Consulate as defined under the Citizenship Act, 1955. Informally obtained or hospital-issued documents will not suffice.

What About Form 49A?

Under the new Act, the old Form 49A for PAN applications has been renamed as Form No. 94. The new guidelines apply to all PAN applications under Forms 93, 94, 95, and 96, depending on the type of applicant.

2. Why October 1, 2023? The Cut-off Explained

The cut-off date is tied to India’s Registration of Births and Deaths (Amendment) Act, 2023, which came into force on October 1, 2023. This amendment made birth registration compulsory for a wide range of official purposes — including school admissions, driving licences, voter registration, Aadhaar, and passports.

Building a Chain of Verified Identity

The Income Tax Department is aligning PAN issuance with the same framework — ensuring that for every child born in the post-amendment era, the official birth registration system serves as the anchor for identity verification. The government is building a verified identity trail from birth itself.

3. Children Born Before October 1, 2023?

No Retroactive Compliance Required

The mandatory birth certificate requirement applies only to children born on or after October 1, 2023. Children born before this date can continue using the existing acceptable documents as proof of date of birth. Parents of older children do not need to worry.

4. Does Every Child Need a PAN Card?

There is no minimum age restriction for obtaining a PAN, and minors under 18 can obtain one — usually through an application submitted by a parent or legal guardian. But not every child needs one immediately. A PAN becomes practically essential in these situations:

  • 🎭The child has income from their own skill, talent, or knowledge — such as a child actor’s fees or a young athlete’s prize money.
  • 🏦You want to open a bank account in the child’s name.
  • 🌸Opening a Sukanya Samriddhi Yojana account for a minor daughter.
  • 📈Investing in mutual funds, fixed deposits, or other instruments in the child’s name.
  • The child has a physical disability as per applicable tax provisions.

Key Tax Principle to Know

A minor’s passive income (like interest from a parent-opened FD) is clubbed with the parent’s income and taxed in the parent’s hands. However, income a child earns through their own effort is taxed separately in the child’s hands — making a PAN indispensable for young earners.

5. What Does a Minor’s PAN Card Look Like?

A minor’s PAN card format is largely similar to a regular PAN card — but with two key differences: it does not display the child’s photograph or signature, and the proof of address provided during the application belongs to the parent or guardian. Children below 18 cannot apply directly; the entire process is completed through a parent or legal guardian.

6. What Happens When the Child Turns 18?

The PAN Number Lasts a Lifetime

The PAN number itself remains valid for life. However, once the individual becomes an adult, the card should be updated to include their photograph and signature. The 10-digit PAN number does not change — only the card details need refreshing. Getting a PAN for a young child is never wasted effort.

7. Bonus for Parents: Massive Hike in Children’s Allowances

Beyond PAN rules, the draft Income-tax Rules, 2026 bring substantial financial relief for salaried employees choosing the old tax regime:

⚠️Important Caveat

These enhanced benefits will not be available to those choosing the new tax regime. Parents must weigh the expanded allowances against the lower slab rates of the new regime before deciding. Both allowances cover up to two children.

8. Practical Checklist for Parents

If your child was born on or after October 1, 2023, here is your action plan:

  • 1️⃣Ensure the birth has been registered with the municipal authority or Registrar of Births and Deaths. If delayed for any reason, initiate the process now through your local civic body.
  • 2️⃣Obtain the official birth certificate from the authorised government office — not just a hospital discharge summary.
  • 3️⃣When applying, use the new Form No. 94 (renamed from Form 49A) and complete the process as the parent or guardian.
  • 4️⃣Keep the birth certificate in a safe, retrievable place — it will be required not just for PAN, but for school admissions, Aadhaar, passports, and more under the post-2023 registration framework.
